BOOKINGS TERMS & CONDITIONS

Please read these terms and conditions carefully. When you make a booking, you accept on behalf of your party the booking terms and conditions. Any breach of these terms and conditions may result in immediate eviction with no refund or cancellation of your booking.

This Booking Agreement is between Crowdy Bay Eco Resort Pty Ltd and the Guest(s) named in theBooking.

Agreed as follow:

1. ACCEPTANCE AND RESPONSIBILITY OF TERMS AND CONDITIONS
Crowdy Bay Eco Resort Pty Ltd accept no responsibility from any claims or causes of action you or any guests may have including negligence arising from any injury, loss or damage of any kind suffered by guests including personal injury, illness or death and/or loss of damage to any property (in so far as this does not breach the provisions of the relevant Australian Consumer Law) arising either directly or indirectly out of your stay at the Property.

Crowdy Bay Eco Resort Pty Ltd does not offer refunds nor does it take responsibility for any adverse weather conditions that may affect your stay.

Crowdy Bay Eco Resort Pty Ltd will do all things reasonably required to ensure the terms of the Agreement are upheld but will not be liable for the consequences there after.

2. RATES AND PAYMENT
Crowdy Bay Eco Resort’s rooms are quoted on a per night, per room basis, Twin Deluxe and Family Deluxe rooms are available. Quoted prices are inclusive of GST where applicable.
Prices may vary at any time without prior notice. You as the guest agree to pay a 50% non refundable deposit and applicable fees upon booking. The remaining balance of the rates at the time of booking is payable in full no later than 14 days prior to arrival.

By agreeing to these terms you as the guest authorize Crowdy Bay Eco Resort to charge the cards used at the time of booking for the remaining amount on your invoice 14 days prior to arrival.

If the booking is made within the 14 days prior to arrival payments must be paid in full.
You as guest acknowledge that your valid credit card details will be held as security and a bond for the booking, Please see Privacy Policy on how your details will be used.

3. PROMOTIONS
Crowdy Bay Eco Resort may make information regarding Promotions available on the Website. The Promotions are subject to any specific terms and conditions set out in each Promotion in addition to the terms and conditions set out in this Agreement. Crowdy Bay Eco Resort reserves the right to change, modify or withdraw any Promotion at any time.

4. SECURITY
Your credit card details will be held on our system for security purposes, You as the guest authorizes Crowdy Bay Eco Resort to charge your credit card for:

  • The cost of repair to any damages
  • Replacement of property.
  • Extra cleaning if the room is left extra dirty.

5. CHECKING IN AND OUT
2pm Check-in will be available on the day of your arrival. Early check-ins may be available subject to availability and a phone call on the day of arrival and not before.

Check-out is strictly 10am on the day of departure, An additional nights stay will be charged if you fail to check out prior to 10am.

Early check-in and late check-out will be subject to availability and will be at the discretion of Management.

6. CANCELLATIONS AND REFUNDS
Please contact us at bookings@crowdybayecoresort.com for any changes or cancellations to your booking.

  1. A 25% cancellation fee of the booking total will be charged for cancellations with more than 90 days notice.
  2. Your 50% deposit of the booking total will be forfeited with cancellations between 14-90 days prior to your check-in date.
  3. Cancellations with less than 14 days notice will incur a 100% cancellation fee of the booking total.
  4. No Cancellations will be accepted on the day of arrival.
  5. Bookings can be rescheduled so long as there is 90 days notice and also subject to availability.

7. PRIVACY
We agree to comply with the Privacy Policy, the Privacy Act 1988 (Cth) and all other applicable privacy laws and such other data protection laws as may be in force from time to time which regulate the collection, storage, use, and disclosure of information about identifiable individuals (Personal Information) held by or on behalf of the Guest to the extent that they are legally obligated to comply with these laws.

8. DAMAGES
All damages and losses are to be reported to Management immediately to avoid being charged for damages not caused by guests.

Guests are responsible for the full cost of repairs and damages such as discoloration to sofa couches and linen that have been caused during their stay.

9. SOCIAL MEDIA AND REVIEWS
Crowdy Bay Eco Resort reserves the right to publish and share reviews and social media posts, and use for the purpose of advertising on our social media platforms and also our website.

Crowdy Bay Eco Resort Pty Ltd ABN 64 662 476 459 is committed to treating the privacy of our customers with utmost importance. A reference in this document to Crowdy Bay Eco Resort includes when Crowdy Bay Eco Resort handles personal information.

The types of personal information we collect

  • Name
  • Date of Birth and gender
  • Address
  • Driver’s license number and/or passport number and, upon our request, a copy of your driver’s license or passport
  • Email addresses/Ip address
  • Telephone numbers
  • Payment information (such as credit card, PayPal or bank details)
  • Financial and transaction details associated with bookings, products and services
  • Special needs or preferences
  • Any preferences you tell us about

How we collect personal information
Generally, we collect personal information directly from you, such as when you request a product or service, in the course of providing you with that product or service.

Why we collect personal information
When you visit or use some parts of our Website and/or Services we might ask you to provide Personal Data to us when you complete an enquiry form, respond to an email offer or to receive promotions or newsletters, or participate with us on social media forums.

Where appropriate, you will be asked to enter your name, email address, mailing address, phone number and/or passport details. By doing so, you are giving this information to us voluntarily, and by providing us with this information you are giving us consent to use, collect and process this Personal Data.

How your personal information will be held
We hold your personal information in encrypted electronic forms, in secure databases or cloud-based platforms that we own and operate or that are owned and operated by our service providers. While we take reasonable steps to protect the security of your personal information, data protection and security measures can never be guaranteed. We, therefore, cannot guarantee the security of your personal information.

When we disclose personal information
Crowdy Bay Eco Resort is concerned with maintaining the privacy of personal information, such information will not be disclosed to third parties that are not directly involved or associated with Crowdy Bay Eco Resort’s business unless:

  • an emergency exists where disclosure of such information will assist in the response
  • a law enforcement agency or person authorized by law requests the disclosure of such
    information for reasons.

Direct Marketing
Personal information may be used for direct marketing purposes where, in absence of an objection, implied consent is assumed. Crowdy Bay Eco Resort will also provide options for a person to opt out of receiving marketing material.

In addition, Crowdy Bay Eco Resort may use information appropriately and lawfully sourced by a third party for direct marketing purposes if the information is not sensitive information and

  • you have not made a request to Crowdy Bay Eco Resort not to receive direct marketing
    communications;
  • In each direct marketing communication with you, Crowdy Bay Eco Resort includes a prominent notice informing you how to opt out if you wish not to receive any further direct marketing communications.

Website Cookies
Some of this information is collected using standard cookies and similar tracking technologies. Cookies are small files that a website or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enable the websites or service providers systems to recognise your browser and capture and remember certain information. We use cookies to keep track of advertisements and compile aggregate data about website traffic and website interaction so that we can offer better website experiences and tools in the future.

CCTV
Crowdy Bay Eco Resort may collect closed circuit television footage (CCTV footage) of you when you enter, access or use facilities at Crowdy Bay Eco Resort
Crowdy Bay Eco Resort may disclose CCTV footage (including where it contains personal information that is not de-identified) to the following parties for the following purposes:

  • to third party security providers for the purpose of security and surveillance
  • our insurer for the purpose of investigating and/or defending public liability claims
  • to law enforcement agencies for the purpose of investigating and/or prosecuting criminal activity, locating missing persons, or as otherwise required or permitted by law.

By accepting this Privacy Policy, you agree to inform any guests traveling with you or visitors that you may invite to our sites or facilities of our collection and disclosure of CCTV footage.
